color: #000000; font-family: Arial, sans-serif; font-size: 13pt; white-space-collapse: preserve;\">While the library occasionally presents educational programs that feature animals, members of the public may only enter the library with an animal if it is a service animal that requires accommodations under the Americans with Disabilities Act (ADA). <\/span><span style=\"background-color: transparent; color: #000000; font-family: Arial, sans-serif; font-size: 13pt; white-space-collapse: preserve;\">Under the ADA, a service animal is an animal that has been individually trained to do work or perform tasks for an individual with a disability.\u00a0 The animal must be trained to take specific action to assist the person with a disability, and the task(s) performed must be directly related to the disability.<\/span><\/p><p dir=\"ltr\" style=\"line-height: 1.38; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"background-color: transparent; color: #000000; font-family: Arial, sans-serif; font-size: 13pt; white-space-collapse: preserve;\">\u00a0<\/span><\/p><p dir=\"ltr\" style=\"line-height: 1.38; margin-top: 0pt; margin-bottom: 0pt;\"><span style=\"font-size: 13pt; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Emotional support therapy, comfort, or companion animals which have not been trained to perform a specific job or task don\u2019t quality as service animals under the ADA.<\/span><\/p><p dir=\"ltr\" style=\"line-height: 1.38; font-family: Arial,sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Is the service animal required because of a disability?<\/span><\/p><\/li><li dir=\"ltr\" style=\"list-style-type: disc; color: #000000; font-family: Arial, sans-serif; font-size: 13pt; white-space-collapse: preserve;\">A staff member attempting to ascertain whether an animal is a service animal will never ask about the nature of a person\u2019s disability.<\/span><\/p><p><span style=\"background-color: transparent; color: #000000; font-family: Arial, sans-serif; font-size: 13pt; white-space-collapse: preserve;\">Service animals must be under the immediate control of their handlers at all times. <\/span><span style=\"background-color: transparent; color: #000000; font-family: Arial, sans-serif; font-size: 13pt; white-space-collapse: preserve;\">Service animals which are not housebroken, make excessive noise, are uncontrolled, or are otherwise disruptive will be required to leave the premises. <\/span><span style=\"background-color: transparent; color: #000000; font-family: Arial, sans-serif; font-size: 13pt; white-space-collapse: preserve;\">Animals may never be left unattended on library grounds. <\/span><span style=\"background-color: transparent; color: #000000; font-family: Arial, sans-serif; font-size: 13pt; white-space-collapse: preserve;\">Service animals are not allowed on library furniture or fixtures, or in library baskets or carts, and must remain on the floor or be carried (as appropriate) by their handlers at all times.<\/span><\/p><p dir=\"ltr\" style=\"line-height: 1.38; margin-top: 0pt; margin-bottom: 0pt;\"><em><span style=\"font-size: 13pt; font-family: Arial, sans-serif; color: #000000; background-color: transparent; font-weight: 400; font-variant: normal; text-decoration: none; The Monroeville Library is a public space, and its resources and services are available to all. To this end, patrons are expected to use the Library without infringing on the ability of anyone else to use the Library. Any activity or behavior that interferes with the ability of other patrons to make use of Library resources and services \u2013 or which damages library materials or property \u2013 is not permitted. Library patrons are expected to use the Library \u2013 including its facilities, grounds, resources and materials \u2013 in a responsible, appropriate and courteous manner. Illegal acts or conduct in violation of Federal, State or local laws, ordinances or regulations are prohibited. This policy applies to patrons of all ages.<\/span><\/li><\/ol><ol start=\"2\"><li><b> Rules and Regulations<\/b><span style=\"font-weight: 400;\"> &#8211; Disruptive activities and behaviors that interfere with the ability of other library users to use the library include, but are not limited to:<\/span><\/li><\/ol><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">excessive noise;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">bullying;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">threatening, harassing, abusive or intimidating language or behavior, including that of a sexual or discriminatory nature;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">engaging in disorderly conduct; drunken, dangerous or threatening behavior; fighting or challenging to fight; running, shouting, pushing, shoving or throwing things; and any other behavior that is disruptive;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">blocking entryways, vestibules, book returns, restrooms, staircases, elevator or other common areas;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">damaging books, computers or other Library property;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">displaying obscene or sexually explicit materials or Internet sites in violation of 18 Pa. Cons. Stat. Sec 5903.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">violent physical contact, including pushing, shoving, hitting, or punching;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">entering \u201cstaff only\u201d areas without permission of Library staff;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">not wearing shirts or shoes;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">no solicitation;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">refusing to comply with requests from Library staff to desist from any disruptive activity or behavior.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">No more than one user is allowed at a computer, except at the discretion of the Library staff. Computer users who fail to comply with these rules and the requests of Library staff may be required to vacate the computer(s).<\/span><\/p><p><span style=\"font-weight: 400;\">Library staff will intervene to stop any disruptive activity or behavior. There is no limit to the number of items that can be taken out on one card.<\/span><\/p><p><span style=\"font-weight: 400;\">Current issues of magazines will be reference only.<\/span><\/p><p><span style=\"font-weight: 400;\">Newspapers do not circulate.<\/span><\/p><p><span style=\"font-weight: 400;\">Most pamphlets are available for circulation.<\/span><\/p><p><span style=\"font-weight: 400;\">All items are available for a 21 day loan.<\/span><\/p><p>\u00a0<\/p><p><b>Renewals<\/b><\/p><p><span style=\"font-weight: 400;\">All items will automatically renew 6 times, unless they are on reserve.<\/span><\/p><p>\u00a0<\/p><p><b>Requests<\/b><\/p><p><span style=\"font-weight: 400;\">Requests (or Holds) may be placed on cataloged materials which are currently in the system. Borrowers may place requests by telephone, through the Library&#8217;s web site, or at the Library. No more than 10 available items will be pulled from the shelves and held for a patron.<\/span><\/p><p>\u00a0<\/p><p><b>Inter-Library Loans<\/b><\/p><p><span style=\"font-weight: 400;\">Inter-Library loan service is available to all. There will be a service charge only in cases when the Monroeville Public Library is charged for postage or special service. Requests must be made in compliance with rules for interlibrary loans. Interlibrary loan materials will be charged out for the loan period of the lending library and may be renewed if that library approves the renewal. They may be returned to any Allegheny County public library. Philosophy and Goals<\/b><\/p><p><span style=\"font-weight: 400;\">The objective of the Monroeville Library is to collect, organize and make available the widest possible diversity of materials in a variety of formats and to serve as a reference and research center providing access to accurate and up-to-date information for the people of Monroeville, Pitcairn, and Allegheny County. The Library endeavors to select materials that will supplement the individual&#8217;s formal schooling, encourage lifelong education, contribute to the intellectual, aesthetic and recreational enjoyment of life, stimulate thought through the presentation of diverse points of view, and further the individual&#8217;s self-realization and growth toward maturity.<\/span><\/p><p>\u00a0<\/p><p><b>II. Responsibility for Selection<\/b><\/p><p><span style=\"font-weight: 400;\">Responsibility for the selection of Library materials rests with the Adult Services Librarian, the Teen Librarian, the Children&#8217;s Librarian and the Library Director, who work within the guidelines of this policy.<\/span><\/p><p>\u00a0<\/p><p><b>III. Selection Criteria and Process<\/b><\/p><p><span style=\"font-weight: 400;\">The Library selects materials in a wide range of formats, using any or all of the following criteria:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Literary merit, artistic quality, aesthetic and recreational value<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Clarity, accuracy and usefulness of information presented<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Social, political and historical significance of the subject matter<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Community needs and popular demand<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Local interest (Pittsburgh and western Pennsylvania)<\/span><\/li><\/ul><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Library staff consult catalogs, bibliographies, and reviews from a variety of sources (professional journals, magazines, newspapers and other media) when selecting materials. Selection may be limited by considerations of cost and collection balance. Patron suggestions are welcomed, and will be considered using the same criteria and process. The Library is committed to collecting materials representing the widest possible diversity of viewpoints and forms of literary and artistic expression.<\/span><\/p><p>\u00a0<\/p><p><b>IV. Withdrawal of Library Materials<\/b><\/p><p><span style=\"font-weight: 400;\">The withdrawal of materials (also known as &#8220;weeding&#8221;) is an ongoing process directly related to collection development. Materials that are worn, damaged, outdated, duplicated or no longer accurate may be removed from the collection. The professional staff of the Library, under the general direction of the Adult Services Librarian, the Teen Librarian, the Children&#8217;s Librarian and the Library Director, are solely responsible for the weeding of the collection.<\/span><\/p><p>\u00a0<\/p><p><b>V. Access to Library Materials<\/b><\/p><p><span style=\"font-weight: 400;\">The Board of Directors of the Monroeville Public Library endorses the principles of the Library Bill of Rights and the Freedom to Read statement adopted by the American Library Association. While anyone is free to reject Library materials of which they do not approve, the freedom of others to access these materials cannot be restricted. The Library does not stand in loco parentis. Parents and guardians have the responsibility to guide the reading, listening and viewing choices of their own minor children. Selection of adult collection materials cannot be inhibited by the possibility that items may be accessed by minors. An individual may express their objections to particular Library materials by completing a &#8220;Request for Reconsideration of Library Material&#8221; form. After the form is completed, it will be brought to the attention of the Adult Services Librarian, the Teen Librarian or the Children&#8217;s Librarian, who will then respond to the person making the objections. Any objections remaining subsequent to this process will then be addressed by the Library Director, and the Board.<\/span><\/p><p>\u00a0<\/p><p><em><span style=\"font-weight: 400;\">Library Board Approved April 2022.<\/span><\/em><\/p><p>\u00a0<\/p><p><b>VI. Requests for Reconsideration Policy<\/b><\/p><p><span style=\"font-weight: 400;\">The Monroeville Public Library Board believes reading is an individual, private matter.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">While anyone is free to select or reject materials for themselves, they cannot restrict the freedom of others to read or inquire. Parents have the primary responsibility to guide and direct the reading of their own minor child. The library does not stand in loco parentis.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">There should be the fullest practicable provision of material presenting all points of view concerning the problems and issues of our times, international, national and local. No materials should ever be excluded because of the beliefs or characteristics of the writer nor be proscribed or removed from the Monroeville Public Library because of partisan or doctrinal disapproval.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Opinions may differ regarding the appropriateness of materials in any library. Resolution of conflicts between freedom of expression and information and the community\u2019s right to restrict certain materials\u2019 use is often a difficult task. In an attempt to insure the rights of all parties, Monroeville Public Library has established procedures for dealing with complaints against materials housed within the library.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">The Monroeville Public Library professional staff, in accordance with its primary obligation of providing the information, within budgetary limitations, which best accommodates all the people in the community, is responsible for the selection of resources for Monroeville Public Library. Members of the Board of Directors must avoid situations in which personal interests might be served or financial benefits gained at the expense of library users, colleagues, or the institution.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">It is incumbent upon any member of the Board of Directors to disclose a conflict of interest when it occurs and to disqualify themselves immediately whenever the appearance of a conflict of interest exists. A conflict of interest is defined in Ordinance No. 1697 of the Municipality of Monroeville as \u201cany situation in which a public official or public employee is in a position where his or her vote or decision can result in a financial benefit to himself or herself or a member of his or her immediate family other than those benefits which may accrue to the public generally.\u201d Members of the Board of Directors must distinguish clearly in their actions and statements between their personal philosophies and attitudes and those of the institution, acknowledging the formal position of the board even if they personally disagree. A member of the Board of Directors must respect the confidential nature of library business while being aware of, and in compliance with, applicable laws governing freedom of information.<\/span><\/p><p>\u00a0<\/p><p><i><span style=\"font-weight: 400;\">Adopted by Library Board on December 12, 2022<\/span><\/i><\/p><p><br \/><br \/><\/p><ol><li><b> Application of Policy<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">This policy applies to board members, staff and certain volunteers of Monroeville Public Library. A volunteer is covered under this policy if that person has been granted significant independent decision-making authority with respect to financial or other resources of the organization.\u00a0 Persons covered under this policy are hereinafter referred to as \u201cinterested parties.\u201d<\/span><\/p><p>\u00a0<\/p><ol><li><b> Conflict of Interest<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">A conflict of interest may exist when the interests or concerns of an interested party may be seen as competing with the interests or concerns of the organization.\u00a0 There are a variety of situations which raise conflict of interest concerns including, but not limited to, the following:<\/span><\/p><p>\u00a0<\/p><p><b>Financial Interests<\/b><span style=\"font-weight: 400;\"> &#8211; A conflict may exist where an interested party, or a relative or business associate of an interested party, directly or indirectly benefits or profits as a result of a decision made or transaction entered into by the organization.\u00a0 Examples include situations where:<\/span><\/p><p>\u00a0<\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the organization contracts to purchase or lease goods, services, or properties from an interested party, or a relative, or business associate of an interested party;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the organization offers employment to an interested party, or a relative, or business associate of an interested party, other than a person who is already employed by the organization;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">an interested party, or a relative or business associate of an interested party, is provided with a gift, gratuity, donation, or favor, of a substantial nature, from a person or entity which does business, or seeks to do business, with the organization;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">an interested party, or a relative or business associate of an interested party, is gratuitously provided use of the facilities, property, or services of the organization;<\/span><\/li><\/ul><p>\u00a0<\/p><p><b>Other Interests<\/b><span style=\"font-weight: 400;\"> &#8211; A conflict may also exist where an interested party, or a relative or business associate of an interested party, obtains a non-financial benefit or advantage that they would not have obtained absent their relationship with the organization, or where their duty or responsibility owed to the organization conflicts with a duty or responsibility owed to some other organization.\u00a0 Additional conflicts may be more subtle and be more in the nature of a duality of interest. Examples include:<\/span><\/p><p>\u00a0<\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">an interested party seeks to obtain preferential treatment by the organization for themselves, or relative, or business associate<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">an interested party seeks to make use of confidential information obtained from the organization for their own benefit, or for the benefit of a relative, business associate, or other organization;<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><b>III. Disclosure of Actual or Potential Conflicts of Interest<\/b><\/p><p><span style=\"font-weight: 400;\">An interested party is under a continuing obligation to disclose any actual or potential conflict of interest as soon as it is known, or reasonably should be known.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">An interested party shall complete a questionnaire, in the form attached hereto, to fully and completely disclose the material facts about any actual or potential conflicts of interest.\u00a0 The disclosure statement shall be completed upon their association with the organization, and shall be updated annually thereafter.\u00a0 An additional disclosure statement shall be filed at such time as an actual or potential conflict arises.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">For board members, the disclosure statements shall be provided to the President of the Board, or in the case of the President\u2019s disclosure statement shall be provided to the Secretary of the Board.\u00a0 Copies shall also be provided to the Director.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">In the case of staff or volunteers with significant decision-making authority, the disclosure statements shall be provided to the library Director, or in the case of the Director\u2019s disclosure statement shall be provided to the President of the Board.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">The Secretary of the board shall file copies of all disclosure statements with the official records of the organization.<\/span><\/p><p>\u00a0<\/p><ol><li><b> Procedures for Review of Actual or Potential Conflicts &#8211; Generally<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">Whenever there is reason to believe that an actual or potential conflict of interest exists between Monroeville Public Library and an interested party, the library board shall determine the appropriate organizational response.\u00a0 This shall include, but not necessarily be limited to, invoking the procedures described in Section V, below, with respect to a specific proposed action or transaction.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Where the actual or potential conflict involves an employee of the organization other than the Director, the Director shall, in the first instance, be responsible for reviewing the matter and may take appropriate action as necessary to protect the interests of the library.\u00a0 The Director shall report to the President of the board the results of any review and the action taken.\u00a0 The President, in consultation with the library board, shall determine if any further review or action is required.<\/span><\/p><p>\u00a0<\/p><ol><li><b> Procedures for Addressing Conflicts of Interest &#8211; Specific Transactions<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">Where an actual or potential conflict exists between the interests of Monroeville Public Library and an interested party with respect to a specific proposed action or transaction, Monroeville Public Library shall refrain from the proposed action or transaction until such time as the proposed action or transaction has been approved by the disinterested members of the board of directors of the organization.\u00a0 The following procedures shall apply:<\/span><\/p><p>\u00a0<\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">An interested party who has an actual or potential conflict of interest with respect to a proposed action or transaction of the library shall not participate in any way in, or be present during, the deliberations and decision-making of the organization with respect to such action or transaction.\u00a0 The interested party may, upon request, be available to answer questions or provide material factual information about the proposed action or transaction.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The disinterested members of the board may approve the proposed action or transaction upon finding that it is in the best interests of the library.\u00a0 The board shall consider whether the terms of the proposed transaction are fair and reasonable to the organization and whether it would be possible, with reasonable effort, to find a more advantageous arrangement with a party or entity that is not an interested party.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Approval by the disinterested members of the board shall be by vote of a majority of those in attendance at a meeting at which a quorum is present.\u00a0 An interested party shall not be counted for purposes of determining whether a quorum is present, nor for purposes of determining what constitutes a majority vote.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The minutes of the meeting shall reflect that the conflict disclosure was made, the vote taken and, where applicable, the abstention from voting and participation by the interested party.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><ol><li><b> Conflicts of Interest and Compensation<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">No voting member of the board\u00a0 may receive compensation, directly or indirectly, from the library.\u00a0 In the case of the library Director, that person is precluded from participating in discussion about matters related to their own performance evaluation, benefits, compensation, and grievances against themselves.<\/span><\/p><p>\u00a0<\/p><p><b>VII. Materials should not advertise for private or organizational gain unless the gain is used for the benefit of the community as a whole, such as cultural enhancement. Do not retain drafts of any documents that have been finalized. Library staff will not provide information beyond name, title, and Library contact information.\u00a0 If your exam requires this type of information from the proctor, the library will not be able to provide you with proctoring services.<\/span><\/p><p>\u00a0<\/p><p><b>Scheduling Your Exam<\/b><\/p><p><span style=\"font-weight: 400;\">Proctoring of examinations is available Monday through Friday.<\/span><\/p><p><span style=\"font-weight: 400;\">Exams must be scheduled to allow for completion 30 minutes before Library closing.<\/span><\/p><p><span style=\"font-weight: 400;\">Exams cannot be scheduled evenings or weekends because of insufficient staffing to adequately monitor test takers. Exceptions may be made at the discretion of the librarian.<\/span><\/p><p><span style=\"font-weight: 400;\">Students are required to schedule the exam at least one week in advance to ensure that a convenient date and time are available. If a student needs to reschedule, a new appointment may not be available until the following week.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><b>Fees<\/b><\/p><p><span style=\"font-weight: 400;\">There is a 10.00 fee for proctoring services at the Library.<\/span><\/p><p><span style=\"font-weight: 400;\">There is an additional $5.00 rescheduling fee if a student does not show up or cancels an appointment without 24 hours notice.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><b>Before the Exam<\/b><\/p><p><span style=\"font-weight: 400;\">Provide Librarian with the following information \u2013 Student name, name of institution, phone number and e-mail address of student.<\/span><\/p><p><span style=\"font-weight: 400;\">Exams may be received through the mail, by e-mail or by fax.<\/span><\/p><p><span style=\"font-weight: 400;\">When received from the institution, an exam will be held at the library for 30 days. If the student has not contacted us within 30 days, the exam will be shredded.<\/span><\/p><p><span style=\"font-weight: 400;\">The student is advised to contact the Library several days prior to the exam date to confirm that the test has been received. Borrowers should understand that the payment for lost materials rarely covers the cost of acquiring and processing a replacement.<\/span><\/p><p><span style=\"font-weight: 400;\">Unpaid charges on an account amounting to $10.00 or more will necessitate withholding all borrowing privileges until the account is settled.<\/span><\/p><p>\u00a0<\/p><p><b>Refunds for Lost and Paid Materials<\/b><\/p><p><span style=\"font-weight: 400;\">Refunds for lost and paid materials which have been returned in good condition may be paid from the lost book fund. The billing fee is not refunded. If there is no refund, the borrower may have the option of keeping the material after it has been marked &#8220;withdrawn&#8221; by the Library.<\/span><\/p><p>\u00a0<\/p><p><b>Miscellaneous Charges<\/b><\/p><p><span style=\"font-weight: 400;\">Charges will be made in relation to the amount of damage and will be at the discretion of the librarian. returned.\u00a0 As the due date approaches, the library will notify the patron of the due date and ask that they return it (if the item is not eligible for renewal).\u00a0 If the item is six weeks overdue, a bill will be mailed and if an item is more than six weeks overdue, the account may be referred to a collection agency depending on the registering library.<\/span><\/p><p>\u00a0<\/p><ol start=\"2\"><li><b> Won\u2019t this policy negatively impact the library\u2019s budget?<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">Fines generate approximately 1% of our annual budget, and our statistics show that fine income decreases each year.\u00a0 We are already exploring other ways of generating income to help supplement our operating budget.<\/span><\/p><p>\u00a0<\/p><ol start=\"3\"><li><b> If patrons are not charged overdue fines will items still be returned in a timely manner?<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">Yes, our expectation is that the majority of items checked out will still be returned within a few days of the due date, regardless of an overdue fine.\u00a0 Most library patrons are responsible users and will continue to return items on or near the due date.\u00a0 Other libraries that have made this change have not seen a significant change in the rate of items that are overdue and see around 95% of items returned within one where all have the opportunity to create, achieve, and contribute.\u201d We believe this policy change will help us better accomplish our mission, and research has shown that fines do not effectively teach responsibility.<\/span><\/p><p>\u00a0<\/p><ol start=\"5\"><li><b> Will the library eliminate previously accrued overdue fines?<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">Yes, along with the policy change to cease charging overdue fines on materials, we also granted an amnesty on all overdue fines accrued under the old policy.\u00a0 This includes overdue fines on items from other Allegheny County Library Association libraries.<\/span><\/p><p>\u00a0<\/p><ol start=\"6\"><li><b> Will the library change the wording, frequency, or process of our courtesy notices?<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">We have updated the language on our notices that refers to daily overdue fines.\u00a0 Notices will be sent earlier to help patrons keep track of item due dates.\u00a0 The library will send automated messages by email, phone, and mail, depending on the patron\u2019s account information:<\/span><\/p><ul><li><span style=\"font-weight: 400;\">3-day or 1-day advanced courtesy e-mail notice<\/span><\/li><li><span style=\"font-weight: 400;\">First overdue notice will be sent at 1 day<\/span><\/li><li><span style=\"font-weight: 400;\">Second overdue notice is sent at 2 weeks<\/span><\/li><li><span style=\"font-weight: 400;\">Third overdue notice is sent at 4 weeks<\/span><\/li><li><span style=\"font-weight: 400;\">A paper bill for material replacement is sent at 6 weeks<\/span><\/li><\/ul><p>\u00a0<\/p><ol start=\"7\"><li><b> Will the library change the fee limit at which we block accounts?<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">No changes will be made to the current limits at which the library blocks account privileges (borrowing, renewal, e-resources, and databases access) if more than $10.00 in Much of this information is useful, expanding our information capabilities far beyond what we could before the days of Internet access. Currently, however, it is an unregulated medium. As such, while it offers access to a wealth of material that is personally, professionally, and culturally enriching to individuals of all ages, it also enables access to some material that may be incorrect, offensive, disturbing, sexually explicit and\/or illegal. This information, however, is constitutionally protected unless determined otherwise by a court with appropriate jurisdiction. The Library upholds and affirms, through its adoption of the Library Bill of Rights and the Freedom to Read Statement, the right of each individual to have access to constitutionally protected material. However, Internet workstations shall not be used for any fraudulent or unlawful purpose, including any activity prohibited under any Federal, State or Local Law. The Library prohibits minors from accessing Internet and on-line sites that contain or make reference to explicit sexual and\/or obscene materials as defined by 18 Pa. C.SA. Section 5903.<\/span><\/p><p>\u00a0<\/p><ol><li><b> Responsibilities of Users<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">Patrons at least 12 years of age or in grade 7 or above who display their library card may use the computers in the adult area at the discretion of the librarian on duty. The Adult Services Department requires that users observe the rules and procedures for use as displayed near each webstation. Repeated violations of these rules may lead to expulsion from the Library. Unacceptable and expressly prohibited use of computer resources also includes the following:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Unauthorized copy of copyright- protected material;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Violation of software licensing agreements;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Violation of another user&#8217;s privacy;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Destruction of or damage to equipment, software, or data belonging to the Library or to other users.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Conduct of private business for profit;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">and Refusal to relinquish a computer for needed maintenance.<\/span><\/li><\/ul><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">The Library is not responsible for the following:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Damage to any portable data storage device or data lost on the device while used in any library computer.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Protecting the users&#8217; personal information including but not limited to social security number, credit card number, name, address, phone number, email address, etc.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Problems with any commercial transaction carried out on library computers.<\/span><\/li><\/ul><p>\u00a0<\/p><ol start=\"2\"><li><b> CIPA Compliance<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">The Children&#8217;s Internet Protection Act (CIPA) is a federal law that requires all computers in a public library to be filtered if that library accepts any federal funds for Internet access or computers used for Internet access. (Supreme Court decision: United States v. American Library Ass&#8217;n., Inc., No. 02-361 (June 23, 2003) Monroeville Public Library complies with the requirements of CIPA.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">All computers in the Monroeville Public Library are filtered. Please be aware that filters are unreliable, at times blocking sites of legitimate informational or educational value, or allowing access to sites that are illegal, obscene, or sexually explicit within the meaning of 18 Pa. Cons. Stat. Sec 5903.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Monroeville Public Library uses filtering software that blocks or filters Internet access to some Internet sites that may not be consistent with the policy of Monroeville Public Library.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Parents or legal guardians, and not the Library or its staff, are responsible for monitoring their children&#8217;s use of the Internet and for the information selected and\/or accessed by their children. The Library strongly encourages parents or legal guardians to supervise their children&#8217;s Internet use and to provide them with guidelines about acceptable use.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Monroeville Public Library computers cannot be used for any fraudulent or unlawful purpose, including any activities prohibited under any applicable federal, Pennsylvania, or local laws, including activities in violation of 18 Pa. Cons. Stat. Sec. 5903, which prohibits certain acts of public indecency.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Any adult (17 years of age or older, as defined by CIPA) may request that the filter or technology protection measure be disabled without significant delay by a Monroeville Public Library staff member authorized by the Library Director, consistent with the privacy policy of Monroeville Public Library.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">An authorized Monroeville Public Library staff member may override the filter or technology protection measure for a minor (age 16 years or younger, as defined by CIPA) in the event that the filter wrongly blocks or filters Internet access to a site with legitimate informational value.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Monroeville Public Library cannot be responsible for any patron&#8217;s unauthorized use of a computer with a disabled filter.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">Any patron who wishes to file a complaint about the filtering software on the library computers may do so within thirty (30) days to:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Library Director and\/or the Library Board President;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Director of the Electronic Information Network;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Federal Communications Commission.<\/span><\/li><\/ul><p>\u00a0<\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p>\u00a0<\/p><ol start=\"3\"><li><b> Request to Reconsider Policy<\/b><\/li><\/ol><p><span style=\"font-weight: 400;\">Those objecting to Library Internet Policy can complete a &#8220;Request for Reconsideration of Internet Policy&#8221; form, which may be obtained at the Reference Desk. They cannot be reserved ahead of time.<\/span><\/p><p><span style=\"font-weight: 400;\">Any eligible patron is allowed to borrow one laptop at a time.<\/span><\/p><p><span style=\"font-weight: 400;\">Printing is available from laptops.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><b>Checkout Procedure<\/b><\/p><p><span style=\"font-weight: 400;\">A patron borrowing a laptop is required to present a valid library card. Proof of name and current address must be presented at time of registration for a borrower&#8217;s card. Types of identification include real estate\/mercantile tax receipts, driver&#8217;s license, car registration, currently postmarked mail, most bills, or ID cards with a current date. Out of state non-residents may have borrowing privileges upon payment of a $30.00 yearly fee.<\/span><\/p><p><b>Adult and Juvenile Borrowers<\/b><\/p><p><span style=\"font-weight: 400;\">With parents&#8217; permission children up through grade 8 will be issued Library cards. Children must be able to write or print their own names in order to apply for their cards and a parent or guardian&#8217;s signature is required. The Library upholds and affirms, through its adoption of the Library Bill of Rights and the Freedom to Read Statement, the right of each individual to have access to constitutionally protected material and will not restrict the borrowing privileges of any borrower. Parents may fill out a form to restrict the types of materials that their children under age 14 may borrow. Borrowers at least 14 years of age or in grade 9 or above will be considered adult borrowers.<\/span><\/p><p><b>School, Organization and Business Privileges<\/b><\/p><p><span style=\"font-weight: 400;\">Library cards may be issued to Monroeville and Pitcairn schools, organizations, and businesses. These cards will be issued under the name of the school, organization, or business and will expire three years from the date of application. Application must be approved by the librarian-in-charge. Applications must be signed by the principal of the school, the president of the organization, or the owner or manager of the business. Library cards issued will be kept on file at the Library and may be used by teachers of the school or by representatives of the organization or business. No more than the usual limit of materials may be taken out by a school, organization, or business representative at one time except with prior permission of the department head. However, more than one teacher, organization, or business member may have materials out on the same card at one time. Late fees must be paid for overdue materials. The school, organization, or business will be responsible for all materials borrowed on its card and must pay for all overdue, lost or damaged materials. Non-compliance with these rules may result in loss of library privileges.<\/span><\/p><p><b>Responsibility<\/b><\/p><p><span style=\"font-weight: 400;\">An adult borrower assumes responsibility for all materials borrowed on his card. Paid tutors will be asked to make a $5 per hour donation.\u00a0 Organizations requesting room for their own meetings that are not open to the public will be charged $25 per hour. There is no charge for use.<\/span><\/p><p><span style=\"font-weight: 400;\">Rooms may be booked up to a year in advance.<\/span><\/p><p><span style=\"font-weight: 400;\">All bookings must be approved by library staff to ensure adequate availability for library programs and fair use by community members.<\/span><\/p><p><span style=\"font-weight: 400;\">Extended requests (e.g. bookings over three hours, requests for simultaneous room bookings of more than one room, multiple room bookings over consecutive days, etc.) may not be approved due to high demands for room availability.<\/span><\/p><p><span style=\"font-weight: 400;\">The Program Room may be booked for parties, luncheons, and other social events. These events must be limited to the Program Room.<\/span><\/p><p><span style=\"font-weight: 400;\">Individuals or organizations must:<\/span><\/p><ul><li><span style=\"font-weight: 400;\">Provide a contact name, a phone number, and (if applicable) the name of business, nonprofit, or other organization at the time of registration.<\/span><\/li><li><span style=\"font-weight: 400;\">Indicate if an event is open to the public.<\/span><\/li><li><span style=\"font-weight: 400;\">Indicate if attendees to the event will be charged.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">If inclement weather is expected, the Library will make every attempt to contact the meeting organizer.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><b>Walk-in Use of Rooms\/Silent Study Areas<\/b><\/p><p><span style=\"font-weight: 400;\">For rooms that have not been reserved ahead of time, the following applies:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Walk-in requests for room bookings are available for individuals when rooms are not already scheduled. Requesters must visit the Front Service Desk to access the rooms.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Rooms cannot be locked during use.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Study carrels and\/or tables, in the Silent Study area, are not reservable.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><b>Facilities<\/b><\/p><p><span style=\"font-weight: 400;\">Groups are responsible for their own set-up and clean-up. Library staff is not available for set-up or clean-up. The group using the room must restore the tables, chairs, and equipment to the arrangement in which it was found. Note: The library does not have access to kitchen facilities.<\/span><\/p><p><span style=\"font-weight: 400;\">Meetings must be scheduled during hours the library is open. Set-up and clean-up time must be incorporated into the scheduled booking time and be completed 15 minutes before closing time.<\/span><\/p><p><span style=\"font-weight: 400;\">Neither groups nor library staff can ask another group or program to leave early in order to allow the next group to set up before the next group\u2019s scheduled booking time.<\/span><\/p><p><span style=\"font-weight: 400;\">Refreshments are permitted. No alcoholic beverages are allowed. No smoking. No open flames or Sterno-type burners.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><b>Publicity<\/b><\/p><p><span style=\"font-weight: 400;\"><span style=\"text-decoration: underline;\">The use of event space shall not convey library sponsorship or endorsement.<\/span> If promoting an event, groups must include the following statement on any\/all promotional materials: <\/span><i><span style=\"font-weight: 400;\">[Event] is funded and presented by [organization\/individual] and is not sponsored by the Monroeville Public Library.<\/span><\/i><\/p><p><b>Event publicizing at library:<\/b><\/p><p><span style=\"font-weight: 400;\">A group may submit one flyer for library approval, to be posted on the library\u2019s community bulletin board. Please note that space considerations means that not all flyers submitted will be added to the library\u2019s bulletin board.<\/span><\/p><p><span style=\"font-weight: 400;\">Flyer must include organization\u2019s contact name and number.<\/span><\/p><p><span style=\"font-weight: 400;\">The Library will not post any non-library-sponsored events on our social media.<\/span><\/p><p><span style=\"font-weight: 400;\">The Library will post non-library-sponsored events on the online website calendar if requested by the person booking the event. Usage is open to all per the guidelines from the American Library Association.<\/span><\/p><p><span style=\"font-weight: 400;\"><strong>Scheduling:<\/strong> Due to the wide variety of events and activities for which the use of the meeting rooms may be requested, MPL reserves the right to require additional information on the organization or person booking, as well as the intent of the meeting. Use of the room is at the sole discretion of MPL. MPL reserves the right to deny or revoke use of a room for any lawful reason or due to unforeseen circumstances.<\/span><\/p><p><span style=\"font-weight: 400;\">Library reserves the right to move groups to a comparable space to the one reserved.<\/span><\/p><p><span style=\"font-weight: 400;\"><strong>Damages\/Storage:<\/strong> The applicant agrees to hold MPL harmless from damages, costs or expenses that the applicant may incur as a result of use of room. No personal property is to be stored on the premises. MPL shall not provide long-term storage for outside groups\u2019 materials.<\/span><\/p><p><span style=\"font-weight: 400;\">The Monroeville Public Library is not responsible for any lost or stolen items or injuries that may occur on Library property.<\/span><\/p><p><span style=\"font-weight: 400;\">Youth organizations using the room must meet requirements of their organization and all adults must have state required clearances on file with their organization.<\/span><\/p><p><span style=\"font-weight: 400;\">Youth organizations using any room space must have at least two adults (21 or over) present at all times.<\/span><\/p><p><span style=\"font-weight: 400;\">The sale of products, admission fees, or solicitation of donations is not allowed with one exception: because the library wants to encourage reading, writing, and the appreciation of culture, and because distribution channels for these materials are often lacking, writers, performers, and artists may sell their own works at the library. Prior authorization by the Library Director is required. Those granted authorization will need to provide their own point of sale system.<\/span><\/p><p><span style=\"font-weight: 400;\">For safety reasons, users cannot lock any rooms during use.<\/span><\/p><p><span style=\"font-weight: 400;\">Accidents and\/or injuries must be reported to Library staff and an incident report completed.<\/span><\/p><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><b>Disclaimers:<\/b><\/p><ul><li><span style=\"font-weight: 400;\">The Library assumes no responsibility for any equipment, supplies, or materials brought to the library by any group or individual attending the meeting; nor does it assume any liability for groups or individuals attending a meeting in the library.<\/span><\/li><li><span style=\"font-weight: 400;\">The fact that a group meets in the library does not in any way constitute an approval or endorsement of the group&#8217;s policies or beliefs by the library board, library staff or the Municipality of Monroeville. Authors wishing to contribute self-published books to the library must meet the criteria listed below:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Authors must be Monroeville or Pitcairn residents, or the book must take place in Monroeville or Pitcairn.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Each book must be approved by the appropriate librarian (i.e. the librarian in charge of collection development for the relevant department) before being accepted for placement.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Books will be accepted as donations from the author or publisher.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Books will not be purchased at patron request unless they have been reviewed in standard sources. Patrons may donate copies of authors\u2019 self-published books. They offer general information on the volunteer program and specific training in the procedures used by the library.<\/span><\/p><p><span style=\"font-weight: 400;\">Tax Deduction \u2013 Mileage to and from volunteer work is deductible at the current IRS allowable rate.<\/span><\/p><p><span style=\"font-weight: 400;\">References \u2013 The library may be listed as a reference when needed for applications for school or employment.\u00a0 Request for references from the Monroeville Public Library should be referred to the volunteer\u2019s direct supervisor.<\/span><\/p><p>\u00a0<\/p><p><b>Volunteers Have the Following Rights:<\/b><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Volunteers can expect certain rights when they give freely of their time.<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To receive orientation and adequate asked to complete an application.\u00a0 If the necessary qualifications are met for the specific position, the applicant is asked to attend a training session before starting on the present current proof of their PA Child Abuse history clearance and PA Criminal record check before beginning volunteer service.<\/span><\/li><\/ul><p>\u00a0<\/p><p><b>Placement<\/b><\/p><p><span style=\"font-weight: 400;\">All efforts are made to place anyone interested in volunteer service.\u00a0 However, the Monroeville Public Library cannot offer a guarantee placement of a volunteer.\u00a0<\/span><\/p><p>\u00a0<\/p><p><b>Termination of Service<\/b><\/p><p><span style=\"font-weight: 400;\">Volunteer actions such as, but not limited to gross dereliction of duty, embezzlement, the use of drugs or alcohol on the job, insubordination, non-performance of duties, violation of confidentiality, public altercations with another volunteer, patron or library staff person will be cause for immediate dismissal by the library\u2019s director.<\/span><\/p><p>\u00a0<\/p><p><b>Resignation<\/b><\/p><p><span style=\"font-weight: 400;\">If a volunteer is unable to continue in the volunteer program, a written resignation should be submitted to the library\u2019s volunteer coordinator.<\/span><\/p><p>\u00a0<\/p><p><b>Volunteer Procedures:<\/b><\/p><p><b>Arrival\/Departure<\/b><\/p><p><span style=\"font-weight: 400;\">The volunteer must sign in and out on the Volunteer Register located at the welcome desk.\u00a0 It is important to sign the Volunteer Register in order for library personnel to know who is in the building and to maintain records of the hours of service.<\/span><\/p><p>\u00a0<\/p><p><b>Attendance<\/b><\/p><p><span style=\"font-weight: 400;\">Volunteers are responsible for making every effort to arrive for work at the agreed upon schedule.\u00a0 When a volunteer cannot work as scheduled, it is their responsibility to notify the director.<\/span><\/p><p><span style=\"font-weight: 400;\">During inclement weather, the volunteer should contact his or her supervisor to determine whether or not to report to work.\u00a0 If the library should close early due to inclement weather, the volunteer will be notified.\u00a0 Under no circumstances do we expect the volunteer to put themselves in a dangerous situation to report to work.\u00a0 All we expect is that some contact is made with a supervisor.<\/span><\/p><p>\u00a0<\/p><p><b>General Policies<\/b><\/p><p><b>Confidentiality<\/b><\/p><p><span style=\"font-weight: 400;\">It is the policy of the Monroeville Public Library to regard as confidential any information about patrons and their use of library resources.\u00a0 All volunteers who work on the library\u2019s behalf must comply with this policy.\u00a0 Failure to maintain confidentiality will result in the library\u2019s release of the volunteer.<\/span><\/p><p>\u00a0<\/p><p><b>Dress Code<\/b><\/p><p><span style=\"font-weight: 400;\">The dress code for all volunteers and staff of the library will be in accordance with appropriate office attire or appropriate for the various duties to be performed.\u00a0 Attire should be clean, neat and properly worn to present a favorable impression to the public.<\/span><\/p><p>\u00a0<\/p><p><b>Smoking<\/b><\/p><p><span style=\"font-weight: 400;\">The Monroeville Public LIbrary is a \u201csmoke-free\u201d facility.\u00a0 To accommodate patrons, staff and volunteers who care to smoke, there is a designated area outside the library.<\/span><\/p><p>\u00a0<\/p><p><b>Food<\/b><\/p><p><span style=\"font-weight: 400;\">Volunteers are invited to use the staff lunch room, refrigerator and microwave for lunch, dinner and snacks.\u00a0 All are expected to clean up after Library is concerned with the safety and well being of children in the library, particularly those who are at risk because of their vulnerability. A &#8220;vulnerable&#8221; child is defined as one who is unable to care for his or her physical and psychological needs or is too young to be safe alone inside and outside the facility. To be unattended, a child must be in 9th grade or older. Children attending library programs are, for the duration of the program only, considered to be supervised by library staff and thus are not unattended.<\/span><\/p><p>\u00a0<\/p><p><b>Statement of Policy:<\/b><\/p><p><span style=\"font-weight: 400;\">The accompanying adult is responsible for the vulnerable child while in the library. An accompanying adult may not leave a vulnerable child unattended in the Children&#8217;s Library. An accompanying adult may not leave a vulnerable child in the temporary care of another young child who is fourteen years old or younger. The library cannot be responsible for the safety or well being of any patron beyond the extent reasonably expected of a public facility. The library staff cannot be responsible for any child who is left unattended. The library staff cannot be responsible for preventing children from leaving with an adult who is not the proper chaperone. Children attending library programs are, for the duration of the program only, considered to be supervised by library staff and thus are not unattended. data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>Introduction:<\/strong><\/p><p><span style=\"font-weight: 400;\">The Sarbanes-Oxley Act amended the federal criminal code to create or enhance penalties for retaliation against whistleblowers while a federal investigation is underway.\u00a0 These changes to the criminal code apply to all business entities, possibly including nonprofit organizations, their board members and employees.\u00a0 Therefore, adopting policies and procedures for the protection of whistleblowers is advisable.<\/span><\/p><p><b>Policy:<\/b><\/p><p><span style=\"font-weight: 400;\">The Monroeville Public Library is committed to facilitating open and honest communications relevant to its governance, finances, and compliance with all applicable laws and regulations.\u00a0 The Monroeville Public Library requires directors, volunteers, and employees to observe high standards of business and personal ethics in the conduct of their duties and responsibilities.\u00a0 Employees and representatives of the organization must practice honesty and integrity in fulfilling their responsibilities and comply with all applicable laws and regulations.<\/span><\/p><p><span style=\"font-weight: 400;\">This whistleblower policy reflects the practices and principles of behavior that support this commitment.\u00a0 It is important that the Board of Directors be apprised about unlawful or improper behavior including, but not limited to, any of the following conduct:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">theft;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">financial reporting which is fraudulent, intentionally misleading or negligent in any manner;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">improper or undocumented financial transactions;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">forgery or alteration of documents;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">unauthorized alteration or manipulation of computer files;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">improper destruction of records;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">improper use of library assets, including, but not limited to its funds, supplies, intellectual property, and other assets;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">improper access and\/or use of confidential donor information;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">improper access and\/or use of privileged databases;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">authorizing or receiving compensation for goods not received or services not performed;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">violations of Monroeville Public Library\u2019s conflict-of-interest policy;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">any other improper occurrence regarding cash, financial procedures, or reporting;<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">any abuse of or discrimination against an employee, client, vendor, board member, or person connected with Monroeville Public Library; and<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">a failure by Monroeville Public Library to provide reasonable accommodation for disability or religious belief.<\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">We request the assistance of every director, volunteer and employee who has a reasonable belief or suspicion about any improper transaction.\u00a0 Monroeville Public Library values this input and each director, volunteer and employee should feel free to raise issues of concern, in good faith, without fear of retaliation.\u00a0 Directors, volunteers and employees will not be disciplined, demoted, lose their jobs, or be retaliated against for asking questions or voicing concerns about conduct of this sort.\u00a0 While the library has separate policies which cover harassment and employment discrimination, this Whistleblower Policy applies to these situations to encourage the reporting of such wrongful actions.\u00a0 Interested parties are encouraged to report any such improprieties without fear of retaliation or intimidation.<\/span><\/p><p><span style=\"font-weight: 400;\">Monroeville Public Library will investigate any possible fraudulent or dishonest use or misuse of library resources, or abuse, discrimination, or a failure to provide reasonable accommodation, by management, staff, or volunteers.\u00a0 Monroeville Public Library will take appropriate action against anyone found to have engaged in fraudulent, dishonest, abusive or discriminatory conduct, including disciplinary action, or civil or criminal prosecution when warranted.<\/span><\/p><p><span style=\"font-weight: 400;\">Therefore, all members of Monroeville Public Library staff, directors and volunteers are encouraged to report possible fraudulent, abusive, discriminatory, or dishonest conduct (i.e., to act as a \u201cwhistleblower\u201d), pursuant to the procedures set forth below.<\/span><\/p><p><b>Reporting Responsibility:<\/b><\/p><p><span style=\"font-weight: 400;\">Each director, volunteer, and employee of Monroeville Public Library has an obligation to report in accordance with this Whistleblower Policy<\/span><\/p><p><span style=\"font-weight: 400;\">(a) questionable or improper accounting, financial or auditing matters, and<\/span><\/p><p><span style=\"font-weight: 400;\">(b) violations and suspected violations of Monroeville Public Library\u2019s policies or any unlawful or improper workplace conduct (hereinafter collectively referred to as \u201cConcerns\u201d).<\/span><\/p><p><b>Authority of Board:<\/b><\/p><p><span style=\"font-weight: 400;\">All reported Concerns will be forwarded to the Board in accordance with the procedures set forth herein.\u00a0 The Board shall be responsible for investigating, and making appropriate recommendations to the library director, with respect to all reported Concerns.<\/span><\/p><p><b>Reporting Concerns:<\/b><\/p><p><b>Employees:<\/b><\/p><p><span style=\"font-weight: 400;\">Employees should first discuss their Concern with the Library Director.\u00a0 In addition, if the individual is uncomfortable speaking with the Library Director, or the Library Director is a subject of the Concern, the individual should report their Concern directly to the President of Monroeville Public Library\u2019s Board of Directors.<\/span><\/p><p><span style=\"font-weight: 400;\">If the Concern was reported orally to the Library Director, the reporting individual, with assistance from the Library Director, shall convert the Concern to writing.\u00a0 The Library Director is required to promptly report the Concern to the President of the Board of Directors, which has specific responsibility to investigate all Concerns.\u00a0 If the Library Director, for any reason, does not promptly forward the Concern to the Board, the reporting individual should directly report the Concern to the President of the Board of Directors.\u00a0 Contact information for the President of the Board of Directors may be obtained on the library\u2019s website.\u00a0 Concerns may also be submitted anonymously.\u00a0 Such anonymous Concerns should be in writing and sent directly to the President of the Board of Directors.<\/span><\/p><p><b>Directors and Other Volunteers:<\/b><\/p><p><span style=\"font-weight: 400;\">Directors and other volunteers should submit Concerns in writing directly to the President of the Board of Directors.\u00a0 Contact information for the President may be obtained from the library\u2019s website.<\/span><\/p><p><span style=\"font-weight: 400;\">If the President of the Board of Directors is a subject of the Concern, the individual should report their concern to the Board\u2019s Vice President.<\/span><\/p><p><b>Handling of Reported Violations:<\/b><\/p><p><span style=\"font-weight: 400;\">The Board, as a whole, shall address all reported Concerns.\u00a0 The President will notify the reporter, and if applicable, the Library Director, and acknowledge receipt of the Concern within five business days, if possible.\u00a0 It will not be possible to acknowledge receipt of anonymously submitted Concerns.<\/span><\/p><p><span style=\"font-weight: 400;\">All reports will be promptly investigated by the Board, and appropriate corrective action will be recommended, if warranted by the investigation.\u00a0 In addition, action taken must include a conclusion and\/or follow-up with the reporter, and if applicable, the Library Director, for resolution of the Concern.<\/span><\/p><p><span style=\"font-weight: 400;\">The Board has the authority to retain outside legal counsel, accountants, private investigators, or any other resource, as deemed necessary to conduct a full and complete investigation of the Concern.<\/span><\/p><p><b>Acting in Good Faith:<\/b><\/p><p><span style=\"font-weight: 400;\">Anyone reporting a Concern must act in good faith and have reasonable grounds for believing the information disclosed indicates an improper accounting or auditing practice, or a violation of Monroeville Public Library\u2019s policies.\u00a0 The act of making allegations that prove to be unsubstantiated, and that prove to have been made maliciously, recklessly, or with the foreknowledge that the allegations are false, will be viewed as a serious disciplinary offense and may result in discipline, up to and including dismissal from the volunteer position or termination of employment.\u00a0 Such conduct may also give rise to other actions, including civil lawsuits.<\/span><\/p><p><strong>Rights and Responsibilities of Monroeville Public Library<\/strong><\/p><p><b>Whistleblower Protection:<\/b><\/p><p><span style=\"font-weight: 400;\">Monroeville Public Library will protect whistleblowers as follows:<\/span><\/p><p><span style=\"font-weight: 400;\">Monroeville Public Library will use its best efforts to protect whistleblowers against retaliation.\u00a0 All complaints by Whistleblowers will be handled with sensitivity, discretion and confidentiality to the extent allowed by the circumstances and the law.\u00a0 Generally, this practice means that whistleblower concerns will only be shared with those who have a need to know in order to conduct an effective investigation.\u00a0 (Should disciplinary or legal action be taken against a person or persons as a result of a whistleblower complaint, such persons may also have a right to know the identity of the whistleblower.)<\/span><\/p><p><span style=\"font-weight: 400;\">A whistleblower shall not be subject to retaliation.\u00a0 No punishment for reporting issues will be allowed, even if the claims are unfounded; a reasonable belief or suspicion that unlawful or improper workplace behavior has occurred is enough to create a protected status for the whistleblower.\u00a0 No action can be taken against the whistleblower with the intent or effect of adversely affecting the terms or conditions of the whistleblower\u2019s employment or volunteer position, including but not limited to threats of physical harm, loss of job or volunteer duties, punitive assignments, or impact on salary or wages.\u00a0 Whistleblowers who believe that they have been retaliated against may file a written complaint with the Board President.\u00a0 Any complaint of retaliation will be promptly investigated and appropriate corrective measures taken if allegations of retaliation are substantiated.\u00a0 This protection from retaliation does not prohibit managers or supervisors from taking action, including disciplinary action, in the usual scope of their duties and based on valid performance-related factors.<\/span><\/p><p><b>Posting and Notification:<\/b><\/p><p><span style=\"font-weight: 400;\">This policy is to be posted in the Monroeville Public Library, including in the Employee Manual, and posted on Monroeville Public Library\u2019s website, as part of the board of directors\u2019 information and communicated to all new staff, volunteers and board members as part of their orientation.\u00a0 In addition, each year, after the annual election of the board president, the Library Director will have the responsibility of updating the contact information.<\/span><\/p><p><span style=\"font-weight: 400;\">Whistle Blower Form<\/span><\/p><p><span style=\"font-weight: 400;\"><i>Adopted by Library Board on December 12,
